Article R1322-44-10 of the French Public Health Code

The labelling of packaged natural mineral waters held with a view to sale, offered for sale, sold or distributed free of charge shall include, in addition to the particulars provided for in Article 9 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011, as amended, on the provision of food information to consumers, the following particulars:

1° The name of the source consisting of one or more natural or drilled outlets ;

2° The place of exploitation and, in the cases provided for in Article 26 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011, as amended, on the provision of food information to consumers, a reference to the country of origin;

3° The analytical composition of the packaged natural mineral water with regard to its characteristic constituents;

4° Where applicable, information relating to treatment with ozone-enriched air;

5° Where applicable, mention of other treatments intended to separate certain undesirable constituents, with the exception of filtration or decantation;

6° Warnings relating to levels of certain constituents;

7° The commercial designation, when it differs from the name of the source;

8° The sales name mentioned in article R. 1322-44-9 of this code.

An order of the ministers responsible for consumption and health sets the terms and conditions for applying the provisions mentioned in 4°, 5° and 6°, in particular the concentration limits above which a statement is required on the labelling of packaged waters and the deadlines for applying this provision.

Article R1322-44-10

L’étiquetage des eaux minérales naturelles conditionnées détenues en vue de la vente, mises en vente, vendues ou distribuées à titre gratuit, comporte, outre les mentions prévues à l’article 9 du règlement (UE) n° 1169/2011 du Parlement européen et du Conseil du 25 octobre 2011 modifié concernant l’information des consommateurs sur les denrées alimentaires, les mentions suivantes :

1° Le nom de la source constituée d’une ou plusieurs émergences naturelles ou forées ;

2° Le lieu d’exploitation et, dans les cas prévus par les dispositions de l’article 26 du règlement (UE) n° 1169/2011 du Parlement européen et du Conseil du 25 octobre 2011 modifié concernant l’information des consommateurs sur les denrées alimentaires, la mention du pays d’origine ;

3° La composition analytique de l’eau minérale naturelle conditionnée se rapportant à ses constituants caractéristiques ;

4° Le cas échéant, l’indication se rapportant au traitement à l’aide d’air enrichi en ozone ;

5° Le cas échéant, la mention d’autres traitements ayant pour objet la séparation de certains constituants indésirables, à l’exception de l’opération de filtration ou de décantation ;

6° Les avertissements se rapportant à des teneurs en certains constituants ;

7° La désignation commerciale, lorsqu’elle diffère du nom de la source ;

8° La dénomination de vente mentionnée à l’article R. 1322-44-9 du présent code.

Un arrêté des ministres chargés de la consommation et de la santé fixe les modalités d’application des dispositions mentionnées aux 4°, 5° et 6°, notamment les limites de concentration au-dessus desquelles une mention est requise sur l’étiquetage des eaux conditionnées et les délais d’application de cette disposition.
