Article R1322-9 of the French Public Health Code

Before the holder of the authorisation referred to inarticle R. 1322-8 makes natural mineral water available to the public, the Director General of the Regional Health Agency shall, within two months of receiving the request, check the conformity of the elements on the basis of which the authorisation was granted.

The inspection of the installations and the nature of the samples taken and analysed to check the quality of the water are determined by order of the Minister for Health. They are carried out at the operator’s expense.

If the results of the analyses and the reconciliation comply, the Prefect informs the holder of the authorisation, who may then distribute the water to the public. If this is not the case, the Prefect will give reasons for his refusal. Distribution of the water is deferred until a new inspection, carried out under the conditions set out above, has confirmed compliance.

In all cases, the Regional Health Agency’s report is sent to the authorisation holder.

Avant que le titulaire de l’autorisation mentionnée à l’article R. 1322-8 ne mette à la disposition du public de l’eau minérale naturelle, le directeur général de l’agence régionale de santé procède, dans le délai de deux mois après avoir été saisi, à la vérification de la conformité des éléments sur la base desquels l’autorisation a été accordée.

Le récolement des installations et la nature des prélèvements et analyses d’échantillons de vérification de la qualité de l’eau sont déterminés par arrêté du ministre chargé de la santé. Ils sont effectués aux frais de l’exploitant.

Lorsque les résultats des analyses et du récolement sont conformes, le préfet en informe le titulaire de l’autorisation, qui peut alors assurer la distribution de l’eau au public. Dans le cas contraire, le refus du préfet est motivé. La distribution de l’eau est différée jusqu’à ce qu’une nouvelle vérification, effectuée dans les conditions prévues ci-dessus, ait constaté la conformité.

Dans tous les cas, le rapport de l’agence régionale de santé est transmis au titulaire de l’autorisation.
