In the event of adverse reactions, the Director General of Competition, Consumer Affairs and Fraud Control shall, at his request, send the Director General of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail any information relating to the composition of each of the products mentioned in Article R. 1323-1 that it may require in order to carry out its duties, in particular the exact concentration of the ingredient(s) used in the composition of the foodstuff, its trade name, the category to which it belongs, the capacity of the various packagings marketed, its conditions of use and any other useful information relating in particular to the quality of the raw materials and the finished product, the manufacturing or extraction process and self-monitoring.
In the case of a product manufactured or marketed in another Member State of the European Union, the distributor responsible for first placing the product on the national market shall forward to the Directorate-General for Competition, Consumer Affairs and Fraud Control the information resulting from the labelling and any other information available to it under the obligations arising from Article 19(2) of Regulation (EC) No 178/2002 referred to above.
In the event of serious undesirable effects, the producers and distributors responsible for first placing the product on the national market are required to provide the information provided for in the first and second paragraphs of this Article respectively to the Director General of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail (French National Agency for Food, Environmental and Occupational Health Safety) when he makes a reasoned request. The latter will inform the Director General of Competition, Consumer Affairs and Fraud Control of the request.
