Article R1331-18 of the French Public Health Code

A basement may be made available for residential purposes if its characteristics do not constitute a health risk for the occupant and if it meets the following cumulative conditions:

-it meets the requirements for ceiling height, openings to the outside, lighting and configuration set out in articles R. 1331-20 to R. 1331-23 respectively;

-the openings to the outside do not expose the occupants to sources of pollution, in particular exhaust emissions from internal combustion engine vehicles;

-it is designed for residential use.

The ground floor or garden level of houses built on land with a slope of 10 degrees or more are not basements.

Article R1331-18

Un sous-sol peut être mis à disposition aux fins d’habitation si ses caractéristiques ne constituent pas un risque pour la santé de l’occupant et s’il répond aux conditions cumulatives suivantes :

-il satisfait aux exigences de hauteur sous-plafond, d’ouverture sur l’extérieur, d’éclairement et de configuration posées respectivement par les articles R. 1331-20 à R. 1331-23 ;

-les ouvertures sur l’extérieur n’exposent pas les occupants à des sources de pollution, notamment, à des émissions des gaz d’échappement de véhicules à moteurs thermiques ;

-il est aménagé à usage d’habitation.

Les rez-de-chaussée ou les rez-de-jardin de maisons implantées sur des terrains d’une pente égale ou supérieure à 10 degrés ne sont pas des sous-sols.
