I.-Ionising radiation sources and batches of radioactive sources are classified in category A, B, C or D as defined in Annexes 13-7 and 13-8.
The person responsible for a nuclear activity shall inform the competent authority responsible for protection against malicious acts of the classification of the sources or batches of sources that he holds or uses.
II – The person responsible for a nuclear activity may request that his ionising radiation source or batch of radioactive sources be placed in a different category from that resulting from I, on the basis of an analysis of the dangerousness of the sources and their vulnerability to malicious acts.
In this case, the competent authority responsible for protection against malicious acts shall determine the category to which the sources or batches of sources belong in an individual decision or, where applicable, in the authorisation issued to the person responsible for the nuclear activity.
When the application results in a category D classification for a nuclear activity mentioned in the fourth paragraph of III of Article L. 1333-9, the Nuclear Safety Authority notifies the person responsible for the nuclear activity of an individual decision.
If the competent authority remains silent for more than six months, the application referred to in the first paragraph will be rejected.
