If the Prefect, on receipt of a referral from the Director General of the Regional Health Agency, considers that one of the requirements resulting from articles R. 1335-16 to R. 1335-20 has not been complied with, he shall give formal notice to the operator, by any means capable of giving a date certain to the notification of this formal notice, to take preventive or corrective measures within a specified period. The operator has seven days from the date of notification to submit its observations.
If there is no response or if the operator’s observations are insufficient, the Prefect may, after consulting the Director General of the Regional Health Agency, prohibit the use of the collective misting system.
The operator must inform the Director General of the Regional Health Agency, who will inform the Prefect, of the preventive or corrective measures implemented. The Prefect, after consulting the Director General of the Regional Health Agency, may lift the ban on the use of collective misting equipment.
In the event of an imminent risk to public health, the Prefect may, without prior formality, prohibit the use of a collective water misting system.
