During meetings devoted to issues of health, safety and working conditions, the chairman of the Agency and Working Conditions Committee or, where applicable, of the specialised committee on health, safety and working conditions may, on his own initiative or at the request of the majority of the committee members present and voting, call in an authorised expert to be heard on a point included on the agenda or :
1° In the event of a serious risk, whether or not revealed by an accident in the course of duty or an accident at work, or in the event of an occupational or work-related illness;
2° In the event of a major project modifying health and safety conditions or working conditions that is not linked in any way to the reorganisation of the department.
The costs incurred by the authorised expert shall be borne by the Agency.
The Director General of the Regional Health Agency shall provide the authorised expert with the information required for his assignment. The latter is subject to the obligation of discretion.
The Chairman informs the Committee of his decision to refuse to call in an expert.
In the event of serious and persistent disagreement, the procedure provided for in article 5-5 of the aforementioned decree of 28 May 1982 shall be applied.
