The electoral quotient is calculated by college or, if there is one, by sub-college.

The pre-electoral agreement may provide, depending on the specific circumstances of each regional health agency and with the unanimous agreement of the trade union organisations representing health insurance staff taking part in its negotiation, for a change in the composition of the sub-colleges or the constitution of a single college of private-law employees governed by the collective agreements applicable to the staff of social security bodies.

When, for the allocation of a seat, the lists obtain the same average, the seat is allocated to the list having obtained the greatest number of votes. If the lists in question have obtained the same number of votes, the seat is awarded to the list that has presented the greatest number of candidates for the Agency and Working Conditions Committee. If several of these lists have obtained the same number of votes and have presented the same number of candidates, the seat is awarded by drawing lots.

Le quotient électoral est calculé par collège ou, s’il existe, par sous-collège.

Le protocole d’accord préélectoral peut prévoir, en fonction des circonstances propres à chaque agence régionale de santé et à l’unanimité des organisations syndicales représentant les personnels de l’assurance maladie participant à sa négociation, la modification de la composition des sous-collèges ou la constitution d’un collège unique des agents de droit privé régis par les conventions collectives applicables au personnel des organismes de sécurité sociale.

Lorsque, pour l’attribution d’un siège, des listes obtiennent la même moyenne, le siège est attribué à la liste ayant obtenu le plus grand nombre de suffrages. Si les listes en cause ont recueilli le même nombre de voix, le siège est attribué à celle qui a présenté le plus grand nombre de candidats au titre du comité d’agence et des conditions de travail. Si plusieurs de ces listes ont obtenu le même nombre de voix et ont présenté le même nombre de candidats, le siège est attribué par voie de tirage au sort.
