Article R1432-88 of the French Public Health Code

The validity of the pre-electoral memorandum of understanding concluded between the Director General of the Agency and the trade union organisations concerned is subject to its signature by the majority of the trade union organisations that took part in its negotiation.

In the absence of signature at the end of the negotiations provided for in the previous paragraph, the Director General of the Agency shall set the rules for the organisation of the elections.

La validité du protocole d’accord préélectoral conclu entre le directeur général de l’agence et les organisations syndicales intéressées est subordonnée à sa signature par la majorité des organisations syndicales ayant participé à sa négociation.

A défaut de signature à l’issue de la négociation prévue à l’alinéa précédent, le directeur général de l’agence fixe les règles d’organisation des élections.
