Article R1432-89 of the French Public Health Code

Staff who have reached the age of sixteen and who are not subject to any prohibition, disqualification or incapacity relating to their civic rights are eligible to vote for staff representatives on the Agency and Working Conditions Committee.

These employees must meet the following conditions within the agency:

1° When they are permanent civil servants or practitioners mentioned in 1° of article L. 6152-1, they must be on active service or parental leave or be on secondment or secondment;

2° If they are trainee civil servants, they must be on active service or parental leave;

3° If they are public-sector contract employees or private-sector employees governed by the collective agreements applicable to the staff of social security bodies, they must have an open-ended contract or a contract of at least six months’ duration and have been employed by the agency for at least three months; in addition, they must be performing their duties or be on paid leave or parental leave.

Voter status is determined on the day of the ballot.

Sont électeurs pour les représentants du personnel au sein du comité d’agence et des conditions de travail les personnels âgés de seize ans révolus et ne faisant l’objet d’aucune interdiction, déchéance ou incapacité relatives à leurs droits civiques.

Ces personnels doivent remplir, au sein de l’agence, les conditions suivantes :

1° Lorsqu’ils ont la qualité de fonctionnaire titulaire ou de praticien mentionné au 1° de l’article L. 6152-1, être en position d’activité ou de congé parental ou être accueillis en détachement ou par voie de mise à disposition ;

2° Lorsqu’ils ont la qualité de fonctionnaire stagiaire, être en position d’activité ou de congé parental ;

3° Lorsqu’ils sont agents contractuels de droit public ou agents de droit privé régis par les conventions collectives applicables au personnel des organismes de sécurité sociale bénéficier d’un contrat à durée indéterminée, ou d’un contrat d’une durée minimale de six mois et, être employés depuis au moins trois mois par l’agence ; en outre, ils doivent exercer leurs fonctions ou être en congé rémunéré ou en congé parental.

La qualité d’électeur s’apprécie au jour du scrutin.
