Article R1432-92 of the French Public Health Code

Staff who meet the conditions required to be eligible to vote on the Agency and Working Conditions Committee and who have reached the age of eighteen are eligible to stand for election to the Committee.

However, the spouse of the Director General of the Agency, his or her partner in a civil solidarity pact, his or her cohabitee, ascendants, descendants, brothers, sisters and relatives in the same degree may not stand for election.

If the Director General of the Agency finds that a candidate does not meet the conditions set out in the preceding paragraphs, he shall take a reasoned decision regarding his ineligibility, which he shall notify to the interested party and to the trade union organisation that presented the candidate.

Sont éligibles au comité d’agence et des conditions de travail les personnels remplissant les conditions requises pour être électeur à ce comité et âgés de dix-huit ans révolus.

Toutefois, ne sont pas éligibles le conjoint du directeur général de l’agence, son partenaire lié par un pacte civil de solidarité, son concubin, ses ascendants, descendants, frères, sœurs et alliés au même degré.

Lorsque le directeur général de l’agence constate qu’un candidat ne satisfait pas aux conditions énoncées aux alinéas précédents, il prend une décision motivée relative à son inéligibilité, qu’il notifie à l’intéressé et à l’organisation syndicale ayant présenté le candidat.
