Article R211-39 of the French Insurance Code

The correspondence sent by the insurer in application of articles R. 211-37 and R. 211-38 shall mention, in addition to the information provided for in article L. 211-10, the name of the person responsible for following up the accident. It reminds the person concerned of the consequences of failing to reply or replying incompletely. It states that the copy of the police or gendarmerie investigation report that the person concerned may request under article L. 211-10 will be issued free of charge.

This correspondence is accompanied by a notice relating to compensation for victims of road traffic accidents, the model for which is set by joint order of the Minister of Justice, the Minister responsible for insurance and the Minister responsible for social security.

La correspondance adressée par l’assureur en application des articles R. 211-37 et R. 211-38 mentionne, outre les informations prévues à l’article L. 211-10, le nom de la personne chargée de suivre le dossier de l’accident. Elle rappelle à l’intéressé les conséquences d’un défaut de réponse ou d’une réponse incomplète. Elle indique que la copie du procès-verbal d’enquête de police ou de gendarmerie qu’il peut demander en vertu de l’article L. 211-10 lui sera délivrée sans frais.

Cette correspondance est accompagnée d’une notice relative à l’indemnisation des victimes d’accidents de la circulation dont le modèle est fixé par arrêté conjoint du garde des sceaux, ministre de la justice, du ministre chargé des assurances et du ministre chargé de la sécurité sociale.
