Article R211-40 of the French Insurance Code

In addition to the information required by article L. 211-16, the offer of compensation must indicate the valuation of each head of loss, the claims of each third party payer and the sums due to the beneficiary. It shall be accompanied by a copy of the statements produced by the third party payers.

Where applicable, the offer specifies the limitations or exclusions of compensation chosen by the insurer, and the reasons for them. In the event of exclusion of compensation, the insurer is not obliged, in its notification, to provide the information and documents provided for in the first paragraph.

L’offre d’indemnité doit indiquer, outre les mentions exigées par l’article L. 211-16, l’évaluation de chaque chef de préjudice, les créances de chaque tiers payeur et les sommes qui reviennent au bénéficiaire. Elle est accompagnée de la copie des décomptes produits par les tiers payeurs.

L’offre précise, le cas échéant, les limitations ou exclusions d’indemnisation retenues par l’assureur, ainsi que leurs motifs. En cas d’exclusion d’indemnisation, l’assureur n’est pas tenu, dans sa notification, de fournir les indications et documents prévus au premier alinéa.
