Article R211-40 of the French Tourism Code

Subscription to the contract referred to in article R. 211-35 is evidenced by the production of a certificate to the registration commission referred to in article L. 141-2. However, cover does not take effect until 0.00 on the day following the day on which registration is issued.

This document is deemed to be a guarantee. It must contain the following information:

a) Reference to the legal and regulatory provisions;

b) The name of the authorised insurance company;

c) The number of the insurance contract taken out ;

d) The period of validity of the contract;

e) The name and address of the travel operator covered, specifying, if applicable, the company name and address;

f) The extent of cover.

The insured must certify the validity of the contract each year to the registration commission mentioned in article L. 141-2.

Article R211-40

La souscription du contrat mentionné à l’article R. 211-35 est justifiée par la production d’une attestation à la commission d’immatriculation mentionnée à l’article L. 141-2. Toutefois, la garantie ne prend effet que le lendemain du jour de la délivrance de l’immatriculation, à 0 heure.

Ce document vaut présomption de garantie. Il doit porter nécessairement les mentions suivantes :

a) La référence aux dispositions légales et réglementaires ;

b) La raison sociale de l’entreprise d’assurances agréée ;

c) Le numéro du contrat d’assurance souscrit ;

d) La période de validité du contrat ;

e) Le nom et l’adresse précisant s’il y a lieu la raison sociale et l’adresse de l’opérateur de voyages garanti ;

f) L’étendue des garanties.

L’assuré est tenu annuellement d’attester auprès de la commission d’immatriculation mentionnée à l’article L. 141-2 de la validité du contrat.
