Article R211-41 of the French Insurance Code

The request sent by the insurer to a third party payer with a view to the production of its claims shall state the surname, first names and address of the victim, his professional activity and the address of his employer(s). It also clearly states the provisions of articles L. 211-11 and L. 211-12. In the absence of this information, the forfeiture period provided for in the second paragraph of article L. 211-11 does not run.

La demande adressée par l’assureur à un tiers payeur en vue de la production de ses créances indique les nom, prénoms, adresse de la victime, son activité professionnelle et l’adresse de son ou de ses employeurs. Elle rappelle de manière très apparente les dispositions des articles L. 211-11 et L. 211-12. A défaut de ces indications, le délai de déchéance prévu au deuxième alinéa de l’article L. 211-11 ne court pas.
