Article R2112-10 of the French Public procurement code

Where a contract is concluded at a fixed price for non-routine supplies or services or for works, its terms must provide for the updating of its price.
Where a contract is concluded at a fixed price for routine supplies or services, its terms may provide that its price may be updated.
Routine supplies or services are deemed to be those for which the purchaser does not impose technical specifications specific to the contract.

Lorsqu’un marché est conclu à prix ferme pour des fournitures ou services autres que courants ou pour des travaux, ses clauses doivent prévoir les modalités d’actualisation de son prix.
Lorsqu’un marché est conclu à prix ferme pour des fournitures ou services courants, ses clauses peuvent prévoir que son prix pourra être actualisé.
Sont réputés être des fournitures ou services courants ceux pour lesquels l’acheteur n’impose pas des spécifications techniques propres au marché.
