Where the contract refers to general documents, it shall include, where appropriate, an indication of the articles of these documents from which it derogates.
A contract may provide for one or more renewals, provided that its characteristics remain unchanged and that the competitive tendering process has been carried out taking into account its total duration.Unless otherwise stipulated, the renewal provided for in the contract is tacit and the contractor may not oppose it.
Contracts concluded by contracting authorities with a public accounting officer shall specify the administrative and technical conditions to which authorisation and payment are subject.
The prices of services covered by a contract are:1° Either unit prices applied to the quantities actually delivered or performed;2° Or lump-sum prices applied to all or part of the contract, regardless of the quantities delivered or performed.
Subject to the provisions of sub-section 3 of this section, the State, its public establishments other than those of an industrial and commercial nature, local authorities, their public establishments and their groupings conclude a final price contract.
A definitive price may be firm or revisable.
