Article R212-40 of the French Cinema and Moving Image Code

The programming commitment of the operator of a cinematographic entertainment establishment who is not obliged to do so by virtue of the provisions of section 1, for those of its elements that satisfy the objectives listed in article R. 212-31 :
1° Any programming project mentioned in 3° of Article L. 212-23, as soon as it has been notified to the President of the Centre national du cinéma et de l’image animée pursuant to III of Article L. 212-24. Notification of the programming project is made within two months of the date on which the authorisation decision can no longer be appealed;
2° Any programming project mentioned in 4° of article L. 212-23 that is notified to the President of the Centre national du cinéma et de l’image animée with a view to the allocation of selective aid for the creation and modernisation of a film theatre. This programming commitment is appended to the aid agreement signed with the Centre national du cinéma et de l’image animée.
The President of the Centre national du cinéma et de l’image animée sends a copy of the programming projects to the film ombudsman.

Article R212-40

Vaut engagement de programmation de l’exploitant d’un établissement de spectacles cinématographiques qui n’y est pas tenu en vertu des dispositions de la section 1, pour ceux de ses éléments qui satisfont aux objectifs énumérés à l’article R. 212-31 :
1° Tout projet de programmation mentionné au 3° de l’article L. 212-23, dès sa notification au président du Centre national du cinéma et de l’image animée en application du III de l’article L. 212-24. La notification du projet de programmation est effectuée dans un délai de deux mois à compter du jour où la décision d’autorisation ne peut plus faire l’objet d’aucun recours ;
2° Tout projet de programmation mentionné au 4° de l’article L. 212-23 qui est notifié au président du Centre national du cinéma et de l’image animée en vue de l’attribution d’une aide sélective à la création et à la modernisation d’un établissement de spectacles cinématographiques. Cet engagement de programmation est annexé à la convention d’aide conclue avec le Centre national du cinéma et de l’image animée.
Une copie des projets de programmation est transmise par le président du Centre national du cinéma et de l’image animée au médiateur du cinéma.
