Article R2122-9-1 of the French Public procurement code

The purchaser may award a public contract without prior advertising or competitive tendering for innovative works, supplies or services within the meaning of the second paragraph of Article L. 2172-3 and meeting a need with an estimated value of less than 100,000 euros excluding tax.

These provisions also apply to lots whose value is less than 80,000 euros excluding tax for innovative supplies or services or 100,000 euros excluding tax for innovative works and which meet the condition set out in b of 2° of Article R. 2123-1.

When making use of this option, the purchaser must ensure that it selects a relevant tender, makes good use of public funds and does not systematically contract with the same economic operator when there is more than one tender capable of meeting the need.

Article R2122-9-1

L’acheteur peut passer un marché public sans publicité ni mise en concurrence préalables portant sur des travaux, fournitures ou services innovants au sens du second alinéa de l’article L. 2172-3 et répondant à un besoin dont la valeur estimée est inférieure à 100 000 euros hors taxes.

Ces dispositions sont également applicables aux lots dont le montant est inférieur à 80 000 euros hors taxes pour des fournitures ou des services innovants ou à 100 000 euros hors taxes pour des travaux innovants et qui remplissent la condition prévue au b du 2° de l’article R. 2123-1.

Lorsqu’il fait usage de cette faculté, l’acheteur veille à choisir une offre pertinente, à faire une bonne utilisation des deniers publics et à ne pas contracter systématiquement avec un même opérateur économique lorsqu’il existe une pluralité d’offres susceptibles de répondre au besoin.
