Article R2122-9 of the French Public procurement code

The purchasers mentioned in 1° and 2° of article 3 of law no. 81-766 of 10 August 1981 relating to book prices may award a contract for the supply of non-school books for their own needs or to enhance the collections of libraries open to the public, without prior advertising or competitive tendering, in response to a need with an estimated value of less than 90,000 euros excluding tax.
When making use of this option, the purchaser must comply with the obligations set out in article R. 2122-8 and must take into account the need to maintain a dense network of retailers throughout the country to guarantee the diversity of publishing and access to it for as many people as possible.

Les acheteurs mentionnés aux 1° et 2° de l’article 3 de la loi n° 81-766 du 10 août 1981 relative au prix du livre peuvent passer sans publicité ni mise en concurrence préalables un marché de fournitures de livres non scolaires pour leurs besoins propres ou pour l’enrichissement des collections des bibliothèques accueillant du public et répondant à un besoin dont la valeur estimée est inférieure à 90 000 euros hors taxes.
Lorsqu’il fait usage de cette faculté, l’acheteur se conforme aux obligations mentionnées à l’article R. 2122-8 et tient compte de l’impératif de maintien sur le territoire d’un réseau dense de détaillants qui garantit la diversité de la création éditoriale et l’accès du plus grand nombre à cette création.
