Article R2123-19 of the French General Code of Local Authorities

Any member of a town council, governed by Titles I to IV of the general civil service regulations must, when he wishes to benefit from the training leave provided for in article L. 2123-13, submit his request in writing to the hierarchical authority to which he reports at least thirty days in advance, specifying the date and duration of the absence envisaged in this respect, as well as the name of the body responsible for the course or session.The hierarchical authority shall acknowledge receipt of this request.

In the absence of an express reply notified no later than the fifteenth day prior to the start of the course or session, the leave shall be deemed to have been granted.

Tout membre d’un conseil municipal, régi par les titres 1er à IV du statut général de la fonction publique doit, lorsqu’il souhaite bénéficier du congé de formation prévu à l’article L. 2123-13, présenter par écrit sa demande à l’autorité hiérarchique dont il relève trente jours au moins à l’avance en précisant la date et la durée de l’absence envisagée à ce titre, ainsi que la désignation de l’organisme responsable du stage ou de la session.L’autorité hiérarchique accuse réception de cette demande.

A défaut de réponse expresse notifiée au plus tard le quinzième jour qui précède le début du stage ou de la session, le congé est réputé accordé.
