Article R2135-23 of the French Labour Code

In the cases provided for in the third paragraph of article L. 2135-16, the Board of Directors may, by means of a resolution adopted in accordance with the procedures defined in the third paragraph of article R. 2135-15, give formal notice, by any means capable of establishing the date of receipt of this document, to the organisation in question to submit its observations on the breaches observed and to comply with its obligations within a period which it shall determine and which may not be less than fifteen days. This decision is adopted with regard to the list of documents drawn up in application of the provisions of 6° of article R. 2135-14.

If the organisation concerned has not complied with its obligations by the end of this period, the Board of Directors may, by a decision taken in the same way and notified to the organisation in question, suspend the allocation of funding or reduce the amount.

Article R2135-23

Dans les cas prévus au troisième alinéa de l’article L. 2135-16, le conseil d’administration peut, par une délibération adoptée selon les modalités définies au troisième alinéa de l’article R. 2135-15, mettre en demeure, par tout moyen propre à donner date certaine à la réception de cet acte, l’organisation visée de présenter ses observations sur les manquements constatés et de se conformer à ses obligations dans un délai qu’il fixe et qui ne peut être inférieur à quinze jours. Cette délibération est adoptée au regard de la liste des documents établie en application des dispositions du 6° de l’article R. 2135-14.

Lorsque l’organisation intéressée ne s’est pas conformée à ses obligations à l’issue de ce délai, le conseil d’administration peut, par une délibération prise selon les mêmes modalités et notifiée à l’organisation en cause, suspendre l’attribution du financement ou en réduire le montant.
