I.-Third-party donors receive, at the time of donation, the information provided for in Article 13 of Regulation (EU) 2016/679 of 27 April 2016 as well as information on the limitations on their rights provided for in III.
Beneficiaries of medically assisted procreation with a third-party donor are informed of the same information as part of the interviews provided for in Article L. 2141-10.
Pursuant to Article 14(5)(b) and (c) of Regulation (EU) 2016/679 of 27 April 2016, the information requirement does not apply to persons born from medically assisted procreation with a third-party donor. The Agence de la biomédecine shall make the information mentioned in Article 14 of the aforementioned Regulation available on its website and shall provide individual information to persons born of medically assisted procreation with a third-party donor when they make use of the right provided for in Article L. 2143-2.
II.-The persons whose data is processed may exercise their right of access to the data concerning them, as provided for in Article 15 of Regulation (EU) 2016/679 of 27 April 2016, to the exclusion of any personal data relating to another natural person, with the head of the healthcare body or institution mentioned in the third paragraph of Article L. 2142-1 or the Data Protection Officer of the Agence de la biomédecine.
They may exercise their right to rectification as provided for in Article 16 of the same regulation and in particular, for third party donors, request that the data relating to family and professional situation mentioned in Article R. 2143-12 be updated, under the same conditions.
III – Pursuant to Article 23(1)(e) and (i) of Regulation (EU) 2016/679 of 27 April 2016, the right to erasure, the right to restriction and the right to object, provided for respectively in Articles 17, 18 and 21 of the same Regulation, do not apply to the processing.
