Article R2152-14 of the French Labour Code

The declaration of candidacy of a professional employers’ organisation wishing to have its representativeness established at the level of the professional sector pursuant to article L. 2152-1 must be accompanied by the following documents

1° Certificates from the statutory auditor(s) as defined in article R. 2152-6 and IV of article R. 2152-8. These certificates are accompanied by the summary sheet mentioned in article R. 2152-6 ;

2° A copy of the organisation’s articles of association and the receipt for filing them;

3° Information and documents proving that the organisation meets the criteria mentioned in 2°, 3° and 5° of Article L. 2151-1 ;

4° The rules on membership fees laid down by deliberation of the competent body of the statutory territorial structures and organisations in application of article R. 2152-8;

5° The declarations, signed by the statutory auditor(s) and drawn up :

a) By the applicant employers’ professional organisation, of the number of member companies per department, the number of employees employed by these companies, the number per department of these companies employing at least one employee and the number per department of these companies employing a total of less than eleven employees;

b) By the applicant professional employers’ organisation, the number of directly affiliated companies per department, the number of employees employed by these companies, the number per department of these companies employing at least one employee and the number per department of these companies employing a total of less than eleven employees;

c) By the statutory territorial structures defined in I of article R. 2152-8 and the organisations and their territorial structures defined in II of article R. 2152-8, of the number per department of directly affiliated companies, the number of employees employed by these companies, the number per department of these companies employing at least one employee and the number per department of these companies employing a total of less than eleven employees.

These declarations are drawn up in accordance with a model approved by the Minister for Employment.

6° The list of statutory territorial organisations and structures which it requests to be taken into account for the measurement of its audience.

Article R2152-14

Sont joints à la déclaration de candidature d’une organisation professionnelle d’employeurs souhaitant voir établie sa représentativité au niveau de la branche professionnelle en application de l’article L. 2152-1 :

1° Les attestations du ou des commissaires aux comptes définies à l’article R. 2152-6 et au IV de l’article R. 2152-8. Ces attestations sont accompagnées de la fiche de synthèse mentionnée à l’article R. 2152-6 ;

2° Une copie des statuts de l’organisation ainsi que du récépissé de dépôt de ceux-ci ;

3° Les éléments et documents permettant de justifier que l’organisation satisfait aux critères mentionnés aux 2°, 3° et 5° de l’article L. 2151-1 ;

4° Les règles en matière de cotisations fixées par délibération de l’organe compétent des structures territoriales statutaires et organisations en application de l’article R. 2152-8 ;

5° Les déclarations, signées par le ou les commissaires aux comptes et établies :

a) Par l’organisation professionnelle d’employeurs candidate, du nombre par département d’entreprises adhérentes, du nombre de salariés employés par ces entreprises, du nombre par département de ces entreprises employant au moins un salarié et du nombre par département de ces entreprises employant au total moins de onze salariés ;

b) Par l’organisation professionnelle d’employeurs candidate, du nombre par département d’entreprises directement adhérentes, du nombre de salariés employés par ces entreprises, du nombre par département de ces entreprises employant au moins un salarié et du nombre par département de ces entreprises employant au total moins de onze salariés ;

c) Par les structures territoriales statutaires définies au I de l’article R. 2152-8 et les organisations et leurs structures territoriales définies au II de l’article R. 2152-8, du nombre par département d’entreprises directement adhérentes, du nombre de salariés employés par ces entreprises, du nombre par département de ces entreprises employant au moins un salarié et du nombre par département de ces entreprises employant au total moins de onze salariés.

Ces déclarations sont établies conformément à un modèle arrêté par le ministre chargé du travail.

6° La liste des organisations et structures territoriales statutaires dont elle demande la prise en compte pour la mesure de son audience.
