Article R2162-51 of the French Public procurement code

The specific contract shall be awarded to the tenderer who has submitted the most economically advantageous tender on the basis of the award criteria set out in the contract notice or, where the call for competition is made by means of a prior information notice or a periodic indicative notice, in the invitation to confirm interest. These criteria may, where appropriate, be specified in the invitation to tender.

Le marché spécifique est attribué au soumissionnaire qui a présenté l’offre économiquement la plus avantageuse sur la base des critères d’attribution définis dans l’avis de marché ou, lorsque l’appel à la concurrence est effectué au moyen d’un avis de préinformation ou d’un avis périodique indicatif, dans l’invitation à confirmer l’intérêt. Ces critères peuvent, le cas échéant, être précisés dans l’invitation à soumissionner.
