Where, as part of the procedure for awarding a framework agreement concluded with several economic operators, tenders have been submitted in the form of electronic catalogues, the purchaser may provide that the reopening of competition between the holders of the framework agreement for the award of subsequent contracts is to be carried out on the basis of the updated catalogues.
In this case, the purchaser uses one of the following methods:
1° Either it invites the holders of the framework agreement to resubmit their electronic catalogues, adapted to the requirements of the subsequent contract;
2° Or it informs the holders of the framework agreement that it intends to collect, from the electronic catalogues already submitted, the information necessary to compile tenders adapted to the requirements of the subsequent contract, provided that the use of this method has been announced in the consultation documents for the framework agreement. In this case, the purchaser shall inform the holders of the framework agreement of the date and time at which it intends to collect this information and shall give them the option of refusing to do so. It shall allow an appropriate period of time between notification and the actual collection of the information. Before awarding the subsequent contract, the purchaser shall send the information collected to each contract holder concerned to enable them to contest or confirm that the tender drawn up in this way does not contain any material errors.
