I. – The status of elite athlete, elite coach, elite referee and judge, U23 athlete or member of the National Team may be withdrawn or suspended at any time by reasoned decision of the Minister for Sport:
1° At the proposal of the relevant federation, when the person concerned has been the subject of a serious disciplinary sanction taken in accordance with the provisions of the federation’s statutes and regulations;
2° At the initiative of the Minister for Sport, or at the suggestion of the relevant federation:
a) In the event of a duly recorded breach of the legislative and regulatory provisions relating to the fight against doping; in this case, the French Anti-Doping Agency may also request a sanction from the Minister;
b) If the person concerned has failed to fulfil one of the obligations set out in the decree referred to in article L. 221-11 ;
c) Where the person concerned has committed acts likely to justify a conviction for a crime or one of the offences provided for :
-paragraph 2 of Section I of Chapter II of Title II of Book II of the French Criminal Code ;
-Section III of Chapter II of Title II of Book II of the French Criminal Code;
-Section IV of Chapter II of Title II of Book II of the Criminal Code;
-Section I of Chapter III of Title II of Book II of the Criminal Code;
-Section II of Chapter V of Title II of Book II of the Criminal Code;
-Section V of Chapter VII of Title II of Book II of the Criminal Code;
-in this Code ;
– articles L. 3421-1 and L. 3421-4 of the Public Health Code.
3° At the initiative of the Minister for Sport, when an athlete’s state of health no longer allows them to practice their sport within the framework of the federal performance project or when they have not undergone the medical surveillance provided for in article L. 231-6.
II. – When the request for withdrawal is made by the athlete, the Minister responsible for sport will acknowledge this, after the athlete has informed the relevant delegating federation.
