Article R222-1 of the French Sports Code

Each of the delegated federations concerned by the application of this chapter, the list of which is determined by order of the Minister for Sport, shall set up a sports agents’ commission and appoint a sports agents’ representative. The chairman and members of the sports agents’ committee, as well as the sports agents’ representative, are appointed by the relevant governing body. The latter also appoints a deputy for each of them.

The sports agents’ commission participates, along with the inter-federal sports agents’ commission mentioned in article R. 222-7, in the organisation of the sports agent licence examination. It may organise training prior to the issue of the sports agent’s licence. It issues, suspends and withdraws this licence. It pronounces the disciplinary sanctions provided for in article L. 222-19.

The sports agents’ commission draws up draft sports agents’ regulations which it sends to the Minister for Sport for his opinion and then submits to the relevant governing body of the federation for approval. The sports agents’ regulations set out the rules which the Federation is responsible for enacting in application of the legislative and regulatory provisions of this chapter.

The sports agent delegate supervises the activities of sports agents and initiates the procedures likely to lead to the imposition of the sanctions provided for in article L. 222-19. He and his deputy are chosen for their legal and sporting expertise.

Article R222-1

Chacune des fédérations délégataires concernées par l’application du présent chapitre, dont la liste est fixée par arrêté du ministre chargé des sports, constitue une commission des agents sportifs et désigne un délégué aux agents sportifs. Le président et les membres de la commission des agents sportifs, ainsi que le délégué aux agents sportifs, sont nommés par l’instance dirigeante compétente. Celle-ci nomme également un suppléant pour chacun d’eux.

La commission des agents sportifs participe, avec la commission interfédérale des agents sportifs mentionnée à l’article R. 222-7, à l’organisation de l’examen de la licence d’agent sportif. Elle peut organiser une formation préalable à la délivrance de la licence d’agent sportif. Elle délivre, suspend et retire cette licence. Elle prononce les sanctions disciplinaires prévues à l’article L. 222-19.

La commission des agents sportifs élabore un projet de règlement des agents sportifs qu’elle transmet pour avis au ministre chargé des sports puis soumet à l’approbation de l’instance dirigeante compétente de la fédération. Le règlement des agents sportifs fixe les règles qu’il appartient à la fédération d’édicter en application des dispositions législatives et réglementaires du présent chapitre.

Le délégué aux agents sportifs contrôle l’activité des agents sportifs et engage les procédures susceptibles de déboucher sur le prononcé des sanctions prévues à l’article L. 222-19. Il est choisi, ainsi que son suppléant, en raison de ses compétences en matière juridique et sportive.
