The threshold provided for in article L. 2232-8 is set at fifty employees. It is determined for each calendar year during which the employee took part in branch negotiations on the basis of the number of employees in the previous year. The number of employees in the previous year is equal to the monthly average of the number of employees in the company calculated, for each calendar month, in accordance with the procedures set out in articles L. 1111-2 and L. 1251-54.
