Where the performance or functional requirements include environmental characteristics, these may be defined by reference to all or part of an ecolabel, provided that:
1° That the ecolabel is appropriate for defining the characteristics of the supplies or services covered by the contract;
2° That the information contained in the ecolabel has been drawn up on the basis of scientific information;
3° That the ecolabel has been drawn up by means of an open and transparent procedure;
4° That the ecolabel and its detailed specifications are accessible to any interested party.

Lorsque les performances ou les exigences fonctionnelles comportent des caractéristiques environnementales, celles-ci peuvent être définies par référence à tout ou partie d’un écolabel pour autant :
1° Que cet écolabel soit approprié pour définir les caractéristiques des fournitures ou des prestations faisant l’objet du marché ;
2° Que les mentions figurant dans l’écolabel aient été établies sur la base d’une information scientifique ;
3° Que l’écolabel soit établi par une procédure ouverte et transparente ;
4° Que l’écolabel et ses spécifications détaillées soient accessibles à toute personne intéressée.
