The formulation of technical specifications must not prevent compliance with mandatory national technical rules, including those relating to product safety, or with technical requirements intended to guarantee the interoperability required by international standardisation agreements to which France is a signatory.
Where the performance or functional requirements include environmental characteristics, these may be defined by reference to all or part of an ecolabel, provided that:1° That the ecolabel is appropriate for defining the characteristics of the supplies or services covered by the contract;2° That the information contained in the ecolabel has been drawn up on the basis of scientific information;3° That the ecolabel has been drawn up by means of an…
The purchaser may state in the consultation documents that products or services which have been awarded an eco-label are presumed to meet the environmental characteristics mentioned in the technical specifications, but must accept any appropriate means of proof.
