Article R2312-51 of the French Labour Code

In the event of a balance remaining in the budget, the annual surplus from the budget for social and cultural activities may be transferred to the operating budget or to associations in accordance with article L. 2312-84, up to a limit of 10% of this surplus.

This sum and the arrangements for its use are recorded in the annual accounts of the social and economic committee or, where applicable, in the documents referred to in article L. 2315-65 and in the report referred to in article L. 2315-69.

When part of the surplus is transferred to one or more humanitarian associations recognised as being in the public interest in order to promote local or regional actions to combat social exclusion or social reintegration, the deliberation of the social and economic committee specifies the recipients of the sums and, where applicable, the distribution of the sums transferred.

En cas de reliquat budgétaire, l’excédent annuel du budget destiné aux activités sociales et culturelles peut être transféré au budget de fonctionnement ou à des associations conformément à l’article L. 2312-84, dans la limite de 10 % de cet excédent.

Cette somme et ses modalités d’utilisation sont inscrites, d’une part, dans les comptes annuels du comité social et économique ou, le cas échéant, dans les documents mentionnés à l’article L. 2315-65 et, d’autre part, dans le rapport mentionné à l’article L. 2315-69.

Lorsque la partie de l’excédent est transférée à une ou plusieurs associations humanitaires reconnues d’utilité publique afin de favoriser les actions locales ou régionales de lutte contre l’exclusion ou des actions de réinsertion sociale, la délibération du comité social et économique précise les destinataires des sommes et, le cas échéant, la répartition des sommes transférées.
