Article R232-49 of the French Sports Code

Each test includes :

1° Where applicable, informing the person in charge of the test of the athlete’s use of the health products defined in Article L. 5311-1 of the Public Health Code, in particular medicines, whether or not prescribed, or food supplements;

2° A medical examination carried out by the person responsible for the inspection, if he or she is a doctor and considers it necessary;

3° One or more of the samples and screening operations listed in article R. 232-50 of this Code;

4° The drafting and signing of the report.

The athlete may refer to a Therapeutic Use Exemption or an application for a Therapeutic Use Exemption as provided for in article L. 232-2 of the French Sports Code and provide any other information in support of his or her declarations. If the person in charge of the test is a doctor, he may also ask to see the individual medical and sports record book provided for in article L. 231-7 of the same code.

The athlete shall state on the report his date and place of birth, as well as his postal address and, if he has one, the e-mail address to which he will be sent the documents resulting from the test.

Article R232-49

Chaque contrôle comprend :

1° Le cas échéant, l’information de la personne en charge du contrôle de l’utilisation par le sportif des produits de santé définis à l’article L. 5311-1 du code de la santé publique, en particulier de médicaments, qu’ils aient fait ou non l’objet d’une prescription, ou de compléments alimentaires ;

2° Un examen médical auquel la personne chargée du contrôle procède si elle est médecin et si elle l’estime nécessaire ;

3° Un ou plusieurs des prélèvements et opérations de dépistage énumérés à l’article R. 232-50 du présent code ;

4° La rédaction et la signature du procès-verbal.

Le sportif peut faire état d’une autorisation d’usage à des fins thérapeutiques ou d’une demande d’autorisation d’usage à des fins thérapeutiques prévues à l’article L. 232-2 du code du sport et fournir tout autre élément à l’appui de ses déclarations. Si la personne chargée du contrôle est médecin, elle peut en outre se faire présenter le livret individuel médical et sportif prévu à l’article L. 231-7 du même code.

Le sportif mentionne sur le procès-verbal ses date et lieu de naissance, ainsi que son adresse postale et, s’il en dispose, l’adresse électronique auxquelles lui seront adressés les documents consécutifs au résultat du contrôle.
