Article R232-66 of the French Sports Code

The storage of samples after their analysis by the laboratory called in by the French Anti-Doping Agency in application of article L. 232-18 is carried out under the technical conditions provided for by international standards.

The storage period is ten years from the date of the first analysis when the sample was taken :

1° At an international sporting event, within the meaning of Article L. 230-2 ;

2° During a sporting competition at the end of which one of the national titles mentioned in article L. 131-15 or article R. 131-13 is awarded;

3° Or on an athlete subject to the whereabouts requirements set out in article L. 232-15.

This ten-year period may be reduced by reasoned and published decision of the College of the French Anti-Doping Agency.

In all cases, the sample retention period may not be less than the minimum retention period set by international standards.

The storage period is interrupted by any act of investigation or prosecution.

La conservation des échantillons après leur analyse par le laboratoire auquel il a été fait appel par l’Agence française de lutte contre le dopage en application de l’article L. 232-18 s’effectue dans les conditions techniques prévues par les normes internationales.

Le délai de conservation est d’une durée de dix ans à compter de la date de la première analyse lorsque le prélèvement a été effectué :

1° Lors d’une manifestation sportive internationale, au sens de l’article L. 230-2 ;

2° Lors d’une compétition sportive à l’issue de laquelle est délivré l’un des titres nationaux mentionnés à l’article L. 131-15 ou à l’article R. 131-13 ;

3° Ou sur un sportif soumis à l’obligation de localisation prévue à l’article L. 232-15.

Ce délai de dix ans peut être réduit par délibération motivée et publiée du collège de l’Agence française de lutte contre le dopage.

Dans tous les cas, le délai de conservation des échantillons ne peut être inférieur au délai minimum de conservation fixé par les normes internationales.

Le délai de conservation est interrompu par tout acte d’instruction ou de poursuite.
