When the Committee considers that the evidence gathered indicates the Use of a Prohibited Substance or Prohibited Method, and unanimously agrees that it is probable that the athlete has Used a Prohibited Substance or Prohibited Method, the Secretary General shall give the notification provided for in article R. 232-88, attaching the biological passport documentation file and the joint report of the experts.
The athlete is invited to submit his observations within twenty days of this notification.
After considering these comments, or if no comments are submitted within the time limit set out in the previous paragraph, the Committee will issue a new opinion. In the event that one of its members is unable to attend, the Committee shall be completed in accordance with the procedures defined in article R. 232-67-12.
The Committee must unanimously confirm its initial position or declare that it is unable to reach the unanimous conclusion that it is probable that the athlete has used a prohibited substance or prohibited method.
The new opinion is sent without delay to the head of the athlete’s passport management unit, who communicates it to the agency.
