Article R232-67-14 of the French Sports Code

When the Committee considers that the evidence gathered indicates the Use of a Prohibited Substance or Prohibited Method, and unanimously agrees that it is probable that the athlete has Used a Prohibited Substance or Prohibited Method, the Secretary General shall give the notification provided for in article R. 232-88, attaching the biological passport documentation file and the joint report of the experts.

The athlete is invited to submit his observations within twenty days of this notification.

After considering these comments, or if no comments are submitted within the time limit set out in the previous paragraph, the Committee will issue a new opinion. In the event that one of its members is unable to attend, the Committee shall be completed in accordance with the procedures defined in article R. 232-67-12.

The Committee must unanimously confirm its initial position or declare that it is unable to reach the unanimous conclusion that it is probable that the athlete has used a prohibited substance or prohibited method.

The new opinion is sent without delay to the head of the athlete’s passport management unit, who communicates it to the agency.

Lorsque le comité estime que les éléments recueillis indiquent l’usage d’une substance ou méthode interdite, en retenant à l’unanimité qu’il est probable que le sportif ait eu recours à une substance ou à une méthode interdite, le secrétaire général procède à la notification prévue à l’article R. 232-88, à laquelle sont joints le dossier de documentation du passeport biologique ainsi que le rapport conjoint des experts.

Le sportif est invité à présenter ses observations dans un délai de vingt jours à compter de cette notification.

Après avoir pris connaissance de ces observations, ou en cas d’absence d’observations présentées dans le délai prévu à l’alinéa précédent, le comité rend un nouvel avis. En cas d’empêchement d’un de ses membres, ce comité est alors complété suivant les modalités définies à l’article R. 232-67-12.

Le comité doit confirmer sa position initiale à l’unanimité de ses membres ou constater son impossibilité de parvenir à la conclusion unanime qu’il est probable que le sportif ait eu recours à une substance ou à une méthode interdite.

Le nouvel avis est transmis sans délai au responsable de l’unité de gestion du passeport de l’athlète, qui le communique à l’agence.
