Article R2321-3 of the French Public Health Code

For the application of article L. 2321-6, the prefectoral closure order may only be issued after formal notice has been given and if the establishment has not remedied the alleged breaches within the period set by the prefect, on the recommendation of the Director General of the Regional Health Agency.

The decision to close is taken without prior formal notice in cases of immediate danger to the life, health or morals of children.

Pour l’application de l’article L. 2321-6, l’arrêté préfectoral de fermeture ne peut intervenir qu’après mise en demeure et lorsque l’établissement n’a pas remédié, dans le délai fixé par le préfet, sur proposition du directeur général de l’agence régionale de santé, aux manquements qui lui sont reprochés.

La décision de fermeture est prise sans mise en demeure préalable dans les cas de danger immédiat pour la vie, la santé ou la moralité des enfants.
