I. – The fee payable each year to a municipality for the occupation of the municipal public domain by the works of the public electricity transmission and distribution networks is set by the municipal council within the following ceilings:
PR = 153 euros for municipalities with a population less than or equal to 2,000;
PR = (0.183 P – 213) euros for municipalities with a population greater than 2,000 and less than or equal to 5,000;
PR = (0.381 P – 1,204) euros for municipalities with a population greater than 5,000 and less than or equal to 20,000 ;
PR = (0.534 P – 4,253) euros for municipalities with a population of more than 20,000 and less than or equal to 100,000;
PR = (0.686 P – 19,498) euros for municipalities with a population of more than 100,000,
where P represents the unduplicated population of the municipality as resulting from the latest census published by the Institut national de la statistique et des études économiques (INSEE).
The fee ceilings mentioned in this article change on 1 January each year, in proportion to the change in the engineering index, defined in the Journal officiel of 1 March 1974, measured over the twelve months preceding the publication of the index known on 1 January.
II. – The fee payable each year to a public establishment for inter-municipal cooperation or a mixed syndicate for the occupation of its public domain by the works of the public electricity transport and distribution networks is set by the community council or the syndicate committee.
The fee is calculated for each member commune, within the limits of the ceilings mentioned in I, in proportion to the length of the networks installed on the public domain of the public establishment for inter-communal cooperation or the mixed syndicate in relation to the total length of the networks installed on the territory of the commune concerned.
