Article R2333-110 of the French General Code of Local Authorities

In the event that the revenue from fees calculated for the benefit of communes, public establishments for inter-communal cooperation or mixed syndicates pursuant to articles R. 2333-105 to R. 2333-108 is lower than that resulting from the application of the specifications in force, the fees shall continue to be established in accordance with these specifications, unless an agreement is reached between the communes, the public establishments for inter-communal cooperation concerned or the mixed syndicates and their concessionaires.

Au cas où le produit des redevances calculées au profit des communes, des établissements publics de coopération intercommunale ou des syndicats mixtes en application des articles R. 2333-105 à R. 2333-108 est inférieur à celui qui résulte de l’application des cahiers des charges en vigueur, les redevances continuent à être établies en conformité de ces cahiers des charges, sauf entente entre les communes, les établissements publics de coopération intercommunale intéressés ou les syndicats mixtes et leurs concessionnaires.
