Article R2333-120-8 of the French General Code of Local Authorities

No one may be appointed to issue payment notices for the post-parking charge or continue to carry out this activity if they do not meet the following conditions:

1° Be of French nationality or a national of another Member State of the European Union, another State party to the Agreement on the European Economic Area or the Swiss Confederation;

2° Present guarantees of good character and probity, assessed in particular in the light of bulletin no. 3 of the criminal record and enjoyment of civic rights in the State of which the person is a national. For persons who are not of French nationality, these guarantees are established by the production of a document issued by the authorities of the State of which they are a national;

3° Be of legal age and not be placed under court protection, guardianship or curatorship;

4° Take an oath under the conditions provided for in Article R. 2333-120-9.

The agents responsible for issuing the payment notices for the fixed-rate parking charge are appointed, depending on the authority to which they report, by the mayor, the president of the public establishment for inter-communal cooperation or the mixed syndicate or the authorised manager of the contracting third party. In Paris, they are appointed by the Prefect of Police when they come under his authority.

Nul ne peut être désigné pour établir des avis de paiement du forfait de post-stationnement ni continuer à exercer cette activité s’il ne satisfait pas aux conditions suivantes :

1° Etre de nationalité française ou ressortissant d’un autre Etat membre de l’Union européenne, d’un autre Etat partie à l’accord sur l’Espace économique européen ou de la Confédération suisse ;

2° Présenter des garanties d’honorabilité et de probité, appréciées notamment au vu du bulletin n° 3 du casier judiciaire et de la jouissance des droits civiques dans l’Etat dont la personne est ressortissante. Pour les personnes qui ne sont pas de nationalité française, ces garanties sont établies par la production d’un document émanant des autorités de l’Etat dont elles sont ressortissantes ;

3° Etre majeur et ne pas être placé sous sauvegarde de justice, sous tutelle ou sous curatelle ;

4° Prêter serment dans les conditions prévues à l’article R. 2333-120-9.

Les agents chargés d’établir les avis de paiement du forfait de post-stationnement sont désignés, selon l’autorité dont ils relèvent, par le maire, le président de l’établissement public de coopération intercommunale ou du syndicat mixte ou le dirigeant habilité du tiers contractant. A Paris, ils sont désignés par le préfet de police lorsqu’ils relèvent de son autorité.
