I. – A resource indicator is hereby created for the inter-municipal groupings and isolated communes of French Polynesia which corresponds to the sum of:
a) The flat-rate allocation of the global operating allocation defined in article L. 2334-7 received in the previous year;
b) The inter-municipality allocation provided for in l’article L. 5842-8 collected the previous year;
c) The product of the additional centimes issued in the penultimate year for the benefit of the municipalities and public establishments of inter-municipal cooperation with their own tax status pursuant to the article 8 of the law of 24 December 1971 relating to the creation and organisation of communes in the territory of French Polynesia ;
d) The proceeds of the penultimate year of the tax on the rental value of business premises pursuant to Article 8 of the law of 24 December 1971 relating to the creation and organisation of communes in the territory of French Polynesia.
This resource indicator is divided by the number of inhabitants making up the population of the group or commune concerned to form a per capita resource indicator. The average per capita resource indicator is equal to the sum of the resource indicators for the inter-municipal groupings and the resource indicators for the communes that do not belong to any of these groupings, divided by the sum of the populations of the inter-municipal groupings and the communes that do not belong to any of the inter-municipal groupings.
II. – Intercommunal groupings and isolated communes whose per capita resource indicator provided for in I is lower than the average per capita resource indicator for French Polynesia are entitled to an allocation from the fund.
The allocations for each of the inter-municipal groupings and isolated communes eligible under the fund are calculated in proportion to the relative difference between the average per capita resource indicator for French Polynesia and the per capita resource indicator for the inter-municipal grouping or isolated commune, multiplied by its population.
III. – The allocation due to each inter-municipal grouping mentioned in II is distributed between the public establishment of inter-municipal cooperation and its member communes according to the inverse of their contribution to the resource indicator provided for in I.
However, by deliberation taken within two months of notification of the allocation mentioned in the previous paragraph by a two-thirds majority, the deliberative body of the public establishment of inter-municipal cooperation may derogate from the methods of distribution of this allocation defined in the previous paragraph. This distribution takes into account, as a priority, per capita wealth and the size of the population.
The population to be taken into account for the application of this article is that defined in Article L. 2334-2.
IV. – The High Commissioner of the Republic notifies the allocations due to the public establishment for inter-municipal cooperation, its member communes and the isolated communes.
V. – The individual repayments determined for each commune and each establishment of inter-municipal cooperation are made monthly once the distribution of allocations has been notified.
