Without prejudice to the provisions of article L. 2141-14, the purchaser may provide, in the consultation documents, for the possibility of modifying the composition of groupings and of forming new groupings between the submission of applications and the submission of initial tenders or, where appropriate, where justified by circumstances relating to the complexity of the technical specifications, until the end of the negotiation or dialogue.

In the absence of such an indication, groupings may not be formed or modified after the date on which applications are submitted.

If a grouping is modified or formed, all its members must have been authorised to submit a tender or to participate in it, at least as a sub-contractor accepted during the application phase, and the modified or newly formed grouping must comply with the purchaser’s requirements relating to the capacity of candidates.

Sans préjudice des dispositions de l’article L. 2141-14, l’acheteur peut prévoir, dans les documents de la consultation, la possibilité de modifier la composition des groupements et d’en constituer de nouveaux entre la remise des candidatures et la remise des offres initiales ou, le cas échéant, lorsque les circonstances liées à la complexité des spécifications techniques le justifient, jusqu’au terme de la négociation ou du dialogue.

A défaut d’une telle indication, les groupements ne peuvent être constitués ou modifiés après la date de remise des candidatures.

En cas de modification ou de constitution d’un groupement, tous ses membres doivent avoir été autorisés à présenter une offre ou à y participer, au moins en tant que sous-contractant accepté dans la phase de candidature, et le groupement modifié ou nouvellement constitué doit respecter les exigences de l’acheteur relatives aux capacités des candidats.
