Article R2351-8 of the French Public procurement code

Where the purchaser awards the contract on the basis of several criteria, he may authorise the presentation of variants under the following conditions:
1° For contracts awarded in accordance with a formalised procedure, variants are prohibited unless otherwise stated in the invitation to tender;
2° For contracts awarded in accordance with an adapted procedure, variants are authorised unless otherwise stated in the consultation documents.

Lorsque l’acheteur se fonde sur plusieurs critères pour attribuer le marché, il peut autoriser la présentation de variantes dans les conditions suivantes :
1° Pour les marchés passés selon une procédure formalisée, les variantes sont interdites sauf mention contraire dans l’avis d’appel à la concurrence ;
2° Pour les marchés passés selon une procédure adaptée, les variantes sont autorisées sauf mention contraire dans les documents de la consultation.
