Article R2352-2 of the French Public procurement code

The purchaser shall require the tenderer to explain the price or costs proposed in his tender if it appears to be abnormally low in relation to the works, supplies or services.
Justifications may be taken into consideration relating in particular to the following aspects:
1° The method of manufacture of the products, the arrangements for the provision of the services, the construction process;
2° The technical solutions adopted or the exceptionally favourable conditions available to the tenderer for supplying the products or services or for carrying out the work;
3° The originality of the tender;
4° The applicable environmental, social and labour regulations in force at the place where the work is to be carried out;
5° Whether the tenderer has received any State aid.

L’acheteur exige que le soumissionnaire explique le prix ou les coûts proposés dans son offre lorsque celle-ci semble anormalement basse eu égard aux travaux, fournitures ou services.
Peuvent être prises en considération des justifications tenant notamment aux aspects suivants :
1° Le mode de fabrication des produits, les modalités de la prestation des services, le procédé de construction ;
2° Les solutions techniques adoptées ou les conditions exceptionnellement favorables dont dispose le soumissionnaire pour fournir les produits ou les services ou pour exécuter les travaux ;
3° L’originalité de l’offre ;
4° La règlementation applicable en matière environnementale, sociale et du travail en vigueur sur le lieu d’exécution des prestations ;
5° L’obtention éventuelle d’une aide d’Etat par le soumissionnaire.
