The provisions of articles R. 2152-1 and R. 2152-2 apply.
The purchaser shall require the tenderer to explain the price or costs proposed in his tender if it appears to be abnormally low in relation to the works, supplies or services.Justifications may be taken into consideration relating in particular to the following aspects:1° The method of manufacture of the products, the arrangements for the provision of the services, the construction process;2° The technical solutions adopted or the exceptionally favourable conditions…
The provisions of articles R. 2152-4 and R. 2152-5 apply.
Regular, acceptable and appropriate tenders which have not been rejected pursuant to articles R. 2152-1, R. 2152-2 and section 2 shall be ranked in descending order by applying the award criteria.
To award the defence or security contract to the tenderer or, where applicable, to the tenderers who have submitted the most economically advantageous tender, the purchaser shall base itself: 1° Either on a number of non-discriminatory criteria linked to the subject of the contract, in particular quality, price, technical merit, functional or environmental characteristics, cost of use, life-cycle costs within the meaning of Article L. 2312-2, cost-effectiveness, after-sales service and…
In the case of competitive dialogue and innovation partnerships, the most economically advantageous tender is identified on the basis of a number of criteria in accordance with the provisions of 1° of article R. 2352-5.
The provisions of article R. 2152-11 apply.
For contracts awarded in accordance with a formalised procedure, the award criteria shall be weighted or, where weighting is not possible for objective reasons, shall be indicated in descending order of importance. The weighting may be expressed in the form of a range with an appropriate maximum deviation which must reflect the way in which the purchaser values the various criteria.
