To award the defence or security contract to the tenderer or, where applicable, to the tenderers who have submitted the most economically advantageous tender, the purchaser shall base itself:
1° Either on a number of non-discriminatory criteria linked to the subject of the contract, in particular quality, price, technical merit, functional or environmental characteristics, cost of use, life-cycle costs within the meaning of Article L. 2312-2, cost-effectiveness, after-sales service and technical assistance, delivery date, delivery or performance period, security of supply, interoperability and operational characteristics. Other criteria may be taken into account if they are justified by the purpose of the contract;
2° Or on the sole criterion of price, provided that the sole purpose of the contract is the purchase of standardised services or supplies, the quality of which cannot be expected to vary from one economic operator to another.
