Article R241-16-2 of the French Sports Code

The Board may take a decision to close the case if it finds that the offence of which the person concerned is accused has not been established.

This decision shall be notified to the person concerned by registered letter with acknowledgement of receipt or by letter delivered against receipt, as well as, by any means, to the international federation and the sports federation concerned. Where applicable, the person(s) with parental authority or the person’s legal representative are informed in the same way.

If the decision to close the case is taken after the notification of the grievances has been sent to the chairman of the Sanction Committee, the case is no longer referred to the Sanction Committee. In this case, the chairman of the Enforcement Committee is also notified of the decision.

Le collège peut prendre une décision de classement s’il constate que l’infraction reprochée à l’intéressé n’est pas constituée.

Cette décision est notifiée par lettre recommandée avec demande d’avis de réception ou par lettre remise contre récépissé, à l’intéressé, ainsi que, par tout moyen, à la fédération internationale et à la fédération sportive concernées. Le cas échéant, la ou les personnes investies de l’autorité parentale ou le représentant légal de l’intéressé sont informés selon les mêmes modalités.

Lorsque la décision de classement intervient après la transmission de la notification des griefs au président de la commission des sanctions, cette dernière est dessaisie de l’affaire. Dans ce cas, la décision est également notifiée au président de la commission des sanctions.
