When the task entrusted to the project manager includes, in addition to assisting the project owner in awarding public works contracts, supervising the performance of public works contracts and assisting the project owner during acceptance operations, the public works contract includes an undertaking by the contractor to comply with the cost, together with a new tolerance threshold, resulting from the public works contracts awarded by the project owner.
Compliance with this undertaking is checked once all the work required to complete the project has been carried out, taking into account the final total cost of the work resulting from the final accounts and invoices of the economic operators responsible for the work.
In order to monitor compliance with the project manager’s undertaking, the public works contract sets out the procedures for taking account of variations in economic conditions.
If the tolerance threshold is exceeded as a result of the project manager failing to carry out his duties of supervising the performance of the public works contracts and assisting the project owner during acceptance operations, the project manager’s remuneration is reduced. The public works contract sets out the method for calculating this reduction, which may not exceed 15% of the contractor’s remuneration for work performed after the public works contracts have been awarded.

Lorsque la mission confiée au maître d’œuvre comporte, outre l’assistance au maître d’ouvrage pour la passation des marchés publics de travaux, la direction de l’exécution des marchés publics de travaux et l’assistance au maître d’ouvrage lors des opérations de réception, le marché public de maîtrise d’œuvre prévoit un engagement de son titulaire de respecter le coût, assorti d’un nouveau seuil de tolérance, qui résulte des marchés publics de travaux passés par le maître d’ouvrage.
Le respect de cet engagement est contrôlé après exécution complète des travaux nécessaires à la réalisation de l’ouvrage en tenant compte du coût total définitif des travaux résultant des décomptes finaux et factures des opérateurs économiques chargés des travaux.
Pour contrôler le respect de l’engagement du maître d’œuvre, le marché public de maîtrise d’œuvre prévoit les modalités de prise en compte des variations des conditions économiques.
En cas de dépassement du seuil de tolérance résultant d’un manquement du maître d’œuvre dans ses missions de direction de l’exécution des marchés publics de travaux et d’assistance au maître d’ouvrage lors des opérations de réception, la rémunération du maître d’œuvre est réduite. Le marché public de maîtrise d’œuvre détermine les modalités de calcul de cette réduction qui ne peut excéder 15 % de la rémunération du maître d’œuvre correspondant aux éléments de missions postérieurs à l’attribution des marchés publics de travaux.
