Article R2511-16 of the French General Code of Local Authorities

When, in the event of danger or disaster, the mayor of the municipality is required to rehouse dwellings referred to in the first paragraph of article R. 2511-4, these dwellings are not taken into account for the application of this paragraph.

After obtaining the opinion of the arrondissement councils, the city council shall draw up the list of rehousings and the conditions for the allocation, by arrondissement or group of arrondissements, of dwellings whose reservation is made necessary by the execution of renovation, rehabilitation or slum clearance operations falling within the remit of the municipality or by the execution of any other social operation for which the city council requests the application of these provisions. Such reservations may not, however, be made, per arrondissement or group of arrondissements, in respect of more than 75% of the housing referred to in the first paragraph of article R. 2511-4.

Lorsqu’en cas de péril ou de catastrophe, le maire de la commune est tenu de procéder à des relogements dans des logements visés au premier alinéa de l’article R. 2511-4, ces logements ne sont pas pris en compte pour l’application du présent paragraphe.

Après avis des conseils d’arrondissement, le conseil municipal fixe la liste des relogements et les conditions de répartition, par arrondissement ou groupe d’arrondissements, des logements dont la réservation est rendue nécessaire par l’exécution des opérations de rénovation, de réhabilitation ou de résorption de l’habitat insalubre relevant de la commune ou par l’exécution de toute autre opération à caractère social pour laquelle le conseil municipal demanderait l’application des présentes dispositions. Ces réservations ne peuvent toutefois pas se faire, par arrondissement ou groupe d’arrondissements, sur plus de 75 % des logements visés au premier alinéa de l’article R. 2511-4.
