Article R295 of the French Code of Criminal Procedure

The first two paragraphs of article R. 70 are worded as follows:

“Records shall be withdrawn from the criminal record and destroyed by the registrar of the court of first instance in the following cases:

“1° Upon the death of the holder of the record, established in particular by entry in the civil status register of births pursuant to Article 79 of the Civil Code or, if the death has not been brought to the attention of the registrar, when the holder would have reached the age of one hundred and twenty years;”

Les deux premiers alinéas de l’article R. 70 sont rédigés comme suit :

” Les fiches sont retirées du casier judiciaire et détruites par le greffier du tribunal de première instance dans les cas suivants :

” 1° Au décès du titulaire de la fiche, établi notamment par la mention au registre de l’état civil des naissances en application de l’article 79 du code civil ou, si le décès n’est pas parvenu à la connaissance du greffier, lorsque le titulaire aurait atteint l’âge de cent vingt ans ; “
