Article R296 of the French Code of Criminal Procedure

Article R. 71 is worded as follows:

“Art. R. 71.-The registry of the court of first instance of the place of birth, for natural persons, or of the place where the registered office of the company or establishment is located, for legal persons, or, in accordance with the second paragraph of Article R. 62, the automated national criminal records department receives notices from foreign authorities concerning French persons convicted by foreign courts.

“These notices, constituting index cards, are filed at the criminal records office of the court of first instance in the original or, if necessary, after transcription onto a regulatory index card form. “

L’article R. 71 est rédigé comme suit :

” Art. R. 71.-Le greffe du tribunal de première instance du lieu de naissance, pour les personnes physiques, ou du lieu où se trouve le siège de l’entreprise ou de l’établissement, pour les personnes morales, ou, conformément au second alinéa de l’article R. 62, le service du casier judiciaire national automatisé reçoit les avis provenant des autorités étrangères concernant les personnes françaises condamnées par des juridictions étrangères.

” Ces avis, constituant des fiches, sont classés au casier judiciaire du tribunal de première instance en original ou, si c’est nécessaire, après leur transcription sur une formule réglementaire de fiche. “
